Santhiel A. Bustamante, 20, was shot and died Sept. 24 in the parking lot of a shopping center near East Wetmore Road and North First Avenue as he backed his Toyota Camry toward Officer Peter Clegg, police said.Oro Valley police officer cleared of criminal wrongdoing in the September shooting death of a suspected heroin dealer also has been cleared of violating department rules and procedures in the shooting.The finding is part of more than 100 pages of Oro Valley reports given by internal affairs investigators to a police board of inquiry in the case.Clegg fired a number of times, hitting Bustamante four times in the back and arm, according to the medical examiner's report included in the Oro Valley reports.The medical examiner's report said Bustamante had traces of cocaine and opiates in his system.
He was here illegally from Mexico, according to the reports.A man who was with Bustamante in the Toyota when he was shot told police that as officers closed in on them, Bustamante mouthed a vulgar word, threw his car into reverse and backed up until he crashed into a police pickup.Clegg, who was standing near the pickup, thought the Toyota's driver was trying to kill him and opened fire on the man, the reports said.The events leading to the shooting began about noon on Sept. 24 when a Canyon Del Oro High School student was caught smoking heroin in a restroom, the reports said.The boy was arrested on drug charges and agreed to talk to police, including naming his supplier.Police questioned the youth, who was not named in the reports, and he identified his supplier as someone named "Santhiel." The youth told officers the man typically dealt heroin in the areas of North First Avenue and East Fort Lowell Road and North First and East Prince Road, the reports said.Officers spotted Bustamante on East Prince Road near North Campbell Avenue and followed him as he drove to a number of apartment complexes.Bustamante and his passenger ended up in the parking lot at East Wetmore and First Avenue. Police decided to box him into the parking lot and arrest him, the report said.Clegg and his partner, Officer Deren Jackson boxed him in from the rear and Sgt. Michael McBride pulled in front of the Toyota, the reports said.McBride and Jackson yelled at the men in the pickup, identifying themselves as police officers and ordering the men out of the car, police said. Clegg got out of the police truck and began walking toward the Toyota when Bustamante started backing toward him, the reports said.
